Patient Rights & Responsibilities
To ensure your full rights and protections when receiving care at Nam Sai Gon International General Hospital, please carefully read the following regulations concerning patient rights and responsibilities:
PATIENT RIGHTS AND RESPONSIBILITIES
(Chapter II, Law on Medical Examination and Treatment No. 15/2023/QH15 dated January 9, 2023)
I. PATIENT RIGHTS
1. Right to medical examination and treatment
- To be informed and explained about their health status; methods and services of medical examination and treatment; medical service prices; and to be guided on how to monitor, care for themselves, and prevent complications.
- To receive medical examination and treatment using safe methods suitable to their illness, health condition, and the actual conditions of the medical examination and treatment establishment.
2. Right to dignity, health protection, and privacy during medical examination and treatment
- To be respected regardless of age, gender, ethnicity, religion, belief, health condition, economic status, or social standing.
- To have confidentiality of medical records and other personal information provided to medical practitioners during the examination and treatment process, except in cases where the patient consents to disclosure in accordance with legal regulations or as prescribed in Clauses 3 and 4, Article 69 of Law No. 15/2023/QH15.
- To not be stigmatized, discriminated against, abused physically or sexually during the examination and treatment process.
- To not be forced to undergo medical examination or treatment, except in mandatory cases including: Persons with Group A infectious diseases as regulated by the law on prevention and control of infectious diseases; Persons with depression exhibiting suicidal thoughts or behavior; Persons with mental disorders in an agitated state who may pose a danger to themselves, others, or cause property damage; and other cases as prescribed by law.
3. Right to choose in medical examination and treatment
- To choose methods of examination and treatment after receiving full information, explanation, and counseling regarding their illness, possible outcomes, and risks, except where the method requested by the patient is inconsistent with professional and technical regulations.
- To accept or refuse participation in biomedical research related to examination and treatment.
4. Right to be provided with information on medical records and treatment costs
- Patients or their representatives have the right to read, view, copy, record medical records, and request a summary copy of the records in writing.
- To be provided and explained in detail about medical service charges upon request.
5. Right to refuse examination, treatment, and to leave the medical facility
- To refuse medical examination and treatment but must sign a written commitment taking responsibility for the refusal after being advised by the medical practitioner, except in mandatory treatment cases.
- To leave the medical facility before completing treatment against the practitioner’s indication, but must sign a written commitment taking responsibility, except in mandatory treatment cases including: Persons with Group A infectious diseases as regulated by the law on prevention and control of infectious diseases; Persons with depression exhibiting suicidal thoughts or behavior; Persons with mental disorders in an agitated state who may pose a danger to themselves, others, or cause property damage; and other cases as prescribed by law.
6. Right to make complaints and receive compensation
- To make complaints regarding shortcomings, difficulties, obstacles, or other issues during the medical examination and treatment process.
- In the event of a medical incident, the medical facility is responsible for compensating the patient in accordance with the law, unless the medical practitioner is determined by a professional council to have no technical or professional error.
Exercise of rights by patients who have lost legal capacity, have cognitive or behavioral difficulties, limited legal capacity, are minors, or have no relatives
In the case where the patient is an adult and falls into one of the following situations: Loss of legal capacity, cognitive or behavioral difficulties, or limited legal capacity, but has previously prepared a written document expressing their lawful will regarding medical examination and treatment, then such medical examination and treatment shall be carried out according to the patient’s expressed will.
In the case where the patient is an adult and falls into one of the following situations: Loss of legal capacity, cognitive or behavioral difficulties, or limited legal capacity, but has not previously prepared any written document expressing their lawful will regarding medical examination and treatment, the procedures shall be carried out as follows:
- If there is a legal representative, the decision of the representative shall prevail;
- If there is no legal representative, the decision shall be made by the person in charge of professional expertise or the person directly in charge at the medical examination and treatment establishment.
In the case where the patient is a minor, the procedures shall be carried out as follows:
- If there is a legal representative, the decision of the representative shall prevail;
- If there is no legal representative, the decision shall be made by the person in charge of professional expertise or the person directly in charge at the medical examination and treatment establishment.
II. PATIENT RESPONSIBILITIES
1. Obligation to respect healthcare practitioners and other personnel at medical examination and treatment establishments
Patients must respect healthcare practitioners; they must not threaten, harm the life or health, or insult the honor and dignity of healthcare practitioners or other individuals working at the medical examination and treatment establishment.
2. Obligation to comply with regulations on medical examination and treatment
- Patients must provide honest and accurate information related to their identity and health status, and must fully cooperate with healthcare practitioners and other individuals working at the medical examination and treatment establishment.
- Patients must comply with the diagnostic instructions and treatment methods prescribed by healthcare practitioners.
- Patients must comply with, and request that their relatives or visitors comply with, the internal regulations of the medical establishment and the provisions of law on medical examination and treatment.
3. Obligation to pay medical examination and treatment costs
- Patients who participate in health insurance are obligated to pay for medical examination and treatment costs that fall outside the covered scope and coverage level as prescribed by the law on health insurance.
- Patients who do not participate in health insurance are obligated to pay medical examination and treatment costs in accordance with the law.
